Pre Suit
Settlement Negotiations

Pre-suit settlement negotiations can be a viable for resolving disputes without the need for litigation. Our pre-litigation attorneys have successfully settled numerous cases through these between opposing parties. The goal is to find common ground, allowing both sides to reach an agreement and avoid the uncertainties of a trial. This approach not only saves time but also helps in reducing legal costs, making it a practical choice for many clients.

Mediation

Mediation is a type of Alternative Dispute Resolution (ADR) in which an impartial third, known as a Mediator, helps facilitate communication between the disputing parties to achieve a settlement agreement. The Mediator may also highlight the weaknesses in each party's case to encourage them to consider reaching an agreement. This process aims to create a collaborative environment where both sides can find common ground and resolve their differences effectively.  

Mediation make take place voluntarily before or after the filing of the law suit or it may also be ordered by a Judge.  In some cases the Mediation may be a contractual obligation in case of a dispute.  The Mediator does not make a decision in the case, the settlement of the case is left up to the parties. 

Arbitration

Arbitration is an alternative dispute resolution (ADR) a  neutral third party called the Arbitrator acts as a Judge, and hears evidence and testimony from both parties and makes a decision on the case.  In most cases these decisions are binding and final and may not be appealed.  There are cases where the Judge orders a non binding arbitration.  This process is less formal than a trial and usually not as long.  This is also a private and confidential proceeding.  

This process is usually faster and less costly than litigation.  Arbitration is usually used when ordered by a Judge or when the contract has an arbitration clause.  

Litigation

In Litigation a law suit gets filed with the Courts.   Litigation is a more formal process. There are several stages that lead to trial but it is possible that the case settles before trial and most cases settle before a trial.  Some of the stages include: Discovery,  exchange of documents between the parties, depositions, motions practice , research, pre-trial, trial and possibly Appeal. In Florida a Judge usually orders a mediation before the parties go to trial in order to encourage settlement. Litigation can be a lengthy and expensive process.
